The Bombay High Court overruled a Family Court order, allowing them to waive the six-month cooling-off period for divorce.
The court has asked the family court to complete Chahal and Dhanashree's divorce proceedings by March 20, considering the cricketer's participation in the IPL 2025.
According to Bar and Bench, the pair married in December 2020 and have been living apart since June 2022. They decided to seek a divorce before the Bandra Family Court in February of this year. In addition to the petition, the pair submitted an application to waive the cooling period.
Section 13B(2) states that a family court can only consider a mutual divorce petition six months after it is filed. The couple is allowed a cooling-off period to consider options for settlement and reunion. However, because Chahal and Dhanshree had been separated for more than two years, the Bombay High Court determined that the cooling-off clause did not apply in this case.
The petition was submitted under Section 13B of the Hindu Marriage Act, which suggests divorce via mutual consent.
